Section 25 of the Matrimonial Causes Act 1973 sets out all the main factors taken into account when assets are separated after divorce or when dissolving a civil partnership- these are called section 25 factors and taken into consideration each party’s income and assets as well as how long the marriage lasted and the couple’s standard of living during the marriage.

If married earlier, you may be eligible for a filing a divorce on the grounds, as your marriage is irretrievably broken down due to either:

  • Adultery
  • Unreasonable behaviour
  • Desertion for more than two years
  • 2 years separation with other party’s consent
  • 5 years separation

You do not need other party’s consent unless basing the petition on two years separation.
